Regardless, we love our modern cannabis culture, and we will fight to keep it. Some background: As you may be aware, the 2018 Farm Bill is what allowed our industry to take off. That bill’s hemp provisions meant that products could be sold to the public if they contained less than 0.3% Delta 9 THC in their raw, unactivated forms.
Because THC requires activation through heat, light, or digestion, the vast majority of THC products across the country fit that regulation. That allows for highly potent concentrates, edibles, drinks, and more to be federally legal.
In late 2025, the United States Congress passed a bill to reopen the government. Included in that bill was language that would effectively undo the 2018 provisions that made us legal in the first place and that took cannabis culture out of the shadows. This would cause problems for anyone who wants to enjoy hemp’s benefits responsibly and say “Happy 420 Day!” without looking over their shoulders.
To protect the products that we all know and love, Apotheca and other industry leaders have banded with our hundreds of thousands of loyal customers to urge Congress to rework the anti-hemp language before it goes into effect in late 2026.
We asked, and you delivered.
We’ve flooded our elected officials’ inboxes and voicemails. We’ve sent letters. We’ve sent the heads of our corporations to meet with leaders. The roundups you make with your purchases go directly to supporting our lobbying efforts to keep these products we all love safe and legal.
And we’re making headway! Large bipartisan majorities in Congress support changing the language, and we’ve even heard that the White House has received more calls about saving the hemp industry than they have about any other topic. That is how we turn cannabis culture into a coalition.
Make no mistake. This fight isn’t over. The 2025 language remains on the books. It is the law of the land. But customers like you, teamed up with those of us in the industry, are turning the tide. This will be a rapidly evolving situation as the year progresses to the November deadline originally set by last year’s law.
