On December 27, 2020, Congress passed the Consolidated Appropriations Acts of 2021, including the “Preventing Online Sales of E-Cigarette to Children Act” to the which prohibits USPS from shipping vaping products. The intent of this ACT was to prevent underage smoking by applying the same safeguards already in place for cigarette and smokeless tobacco product to the online sales of e-cigarettes. The ACT amends The Jenkins Act, which generally prohibits mailing of cigarettes to consumers through the United State Postal Service, to included Electronic Nicotine Delivery System (ENDS) and to subject them to the same restrictions.
